make the update check optional and not manditory.

You should make the automatic update check on startup to be optional. Not everyone has rights to access external domans from the LAN they are on and attempts to do so could result in disciplinary actions against the logged in user.
Others may have to pay for internet connectivity and having the program dive for the internet on every startup without any in-program control over it is not acceptable.
